LAIS1251.1 SCA Amendment

Parish and town councils (local councils) will be interested in this update on the Sustainable Communities Act 2007. The Act aims to devolve power from Government with relevant funding in order to promote sustainable communities. This would be based on proposals developed locally with the involvement of communities. However, crucial direct references to local councils being involved in the process of proposing measures to sustain communities were not transferred from the original Bill into the 2007 Act.

LAIS1252 Local Charter

There are many references to town and parish councils (local councils) within this Guide. Charters are a concept that local councils will be familiar with. Government has identified them as a way to ensure communities can get involved in decision-making and have further local control over assets and functions. Although Charters are open to many community organisations, they could provide a way for local councils to acquire greater influence and become more empowered to assist their communities.

LAIS1256 National Security Strategy

The publication of the first National Security Strategy has been announced in response to new threats to security. Enhanced community resilience is among the measures proposed within this strategy to address these threats ranging from floods to terrorism. Local councils have been involved in working with communities to ensure very local support networks exist for situations where community self-reliance is essential and will welcome efforts to improve local government community resilience networks. There is no new mandatory requirement to plan for emergencies at a local council level and it is likely that any new measures would continue to be worked through principal local authority tiers.

LAIS1262 Byelaws

Local councils will be aware that a series of measures are emerging in order to progress implementation of community empowerment initiatives and local government review under recent White Papers. The Local Government and Public Involvement in Health Act 2007 is an umbrella legislative vehicle for implementing the White Papers. The Act provides powers to make regulations in certain respects and the Government is now consulting on potential regulations for making and enforcing relevant byelaws.

LAIS1263 Freedom Of Information Act

The Freedom of Information Act 2000 made it the duty of every public authority to adopt and maintain a Publication Scheme. Although councils will have previously adopted a Scheme, the Information Commissioners Office (ICO) is changing the approval and operation of the Scheme and a new Publication Scheme must be adopted and operated by all local councils by 1 January 2009. A model Publication Scheme has been produced to help parish and town councils comply.

LAIS1265 Codes of Conduct

This consultation seeks views on proposals to implement new Model Codes of Conduct for members and for local authority employees. Implementation of both is planned in line with the local government elections in 2009.

LAIS1265.1 Member Officer Protocol

LAIS advised in LAIS1265 of the consultation on the proposed revised Code of Conduct for local council members and a separate Code of Conduct for employees. It is looking increasingly unlikely that the latter will be published. However, one of the constant issues that arises is Member-Officer relations whether this be within an employment or Code of Conduct context. Local councils might wish to consider implementing a Member-Officer protocol to define the terms and standard of relations expected by their members and staff. At very least this ensures all relevant parties have received some instruction on their role and the standard of behaviour expected. An example is provided which might be helpful when considering what is appropriate for an individual council. However, it cannot suit all types of council and, although councils will be eager to retain important points of principle, councils will wish to tailor it to their individual needs.

This statute brings in significant changes to the way in which major infrastructure decisions will be made. Decisions on major infrastructure, such as nuclear power, can considerably affect communities and there will be a democratic deficit as these decisions will be made by a central appointed authority rather than the Secretary of State and local authorities.

LAIS1267.1 Local Democracy Bill

The aim of this LAIS is to update you on an error that has been made in relation to the Explanatory Note to the Local Democracy, Economic Development and Construction Bill in relation to local councils. LAIS informed the Government department, Communities and Local Government (CLG), that it had concerns over the drafting which appeared to presume that no local councils were subject to the same accounting and auditing regime as 'principal' local authorities. In fact, councils with an income or expenditure (whichever is the greater) for the year which exceeds £1 million for three consecutive years must from that third year prepare accounts in accordance with the proper accounting practices found in the CIPFA Statement of Recommended Practice (the SoRP).

LAIS1268 Publicity Code

Local councils will be aware that a series of measures are emerging in order to progress implementation of community empowerment policies and initiatives under recent White Papers. This consultation is on the Publicity Code which was published in 1988. The consultation explores the effectiveness of the Code as a resource to councils seeking to issue legitimate publicity whilst also helping to protect public money from use for political purposes. Concerns have been raised that the drive towards ensuring principal authorities (not local councils) promote democracy will be hindered by the guidance in the Code.

LAIS1269 CRC: Economic Downturn

Local councils will wish to be aware of an important avenue for influence over Government through the Commission for Rural Communities (CRC). Local councils and County Associations of Local Councils can make a contribution in relation to the economic downturn by providing information to the CRC about the effect of the current problems on rural communities. Information provided is considered for inclusion in reports to Government. Local councils might wish to publicise locally the fact that they can gather and pass on information on behalf of residents to the CRC and thence to Government.

LAIS1270 Accountability Guide

A revised Guide to governance, accountability and transparency over financial arrangements within local councils (town and parish councils) was published in 2008. In the context of the economic downturn, a threatened bankruptcy of a town council, a number (albeit low) of problems with fraud and external auditors continuing to pick up basic errors, it is timely to remind councils of the Guide and the need to comply with the accounts and accountability framework. All council and auditors should be familiar with the content of the Guide.

LAIS1271 Comprehensive Area Assessment

The new framework for independent assessment of local public services has been published and is effective from 1 April 2009. The Audit Commission's Comprehensive Area Assessments (CAAs) are based on certain criteria including the level of the authority's delivery of national and local priorities and its understanding of communities and their reflection of this understanding in their priorities. Although the assessments are not made of parish and town councils (local councils), the Audit Commission expects that local councils will have a significant role in community engagement. Reference to the CAA framework might assist local councils and their county associations in increasing their influence over and becoming more informed about other local public services. There is particular reference to the need for public bodies to work well with local councils.
